The Demise of the 28-Clause Ceasefire Plan for Ukraine: How Diplomatic Efforts Continue to Falter

Europe felt a moment of respite on Monday, as the diplomatic emergency sparked by the presentation of a new comprehensive peace framework for resolving the conflict appeared – briefly – to have been contained. A American diplomat spoke of "substantial progress" after bilateral negotiations in Geneva. On Monday night, Moscow made its retaliation: an extensive attack of missile and drone strikes on Kyiv.

The Pattern of Negotiation and Warfare

The sequence of conflicting incidents captured the grim essence of the current period. By day, negotiation efforts are conducted: positive announcements are issued from different nations. Significant resources is devoted on restraining particular approaches. By night, the Kremlin clearly shows the world that, for them, war remains the main instrument for achieving "peace".

Nighttime Reality

As military strikes developed into the early hours of Tuesday, the immediate reality of Ukraine's vulnerability was revealed. Ukraine is equipped to monitor rocket firings from Russian territory, a ability enabled by up-to-date information. From observation points, military aircraft that had been scrambled to intercept incoming guided weapons streaked across the sky – modern combat jets supplied to Ukraine by Western partners.

Moments later, Kyiv's missile defense activated: defensive missiles targeted at a incoming threat. This was a sophisticated defense system at work, most likely supplied through partner states. Every launch shakes the surroundings, rattling buildings. The brief panic quickly gives way to sober acceptance: perhaps the approaching threat won't hit its mark this time, protecting urban areas from ruin and further power outages.

Persistent Threats

Soon after, a heavy machine gun opened up on a drone close by, part of a defensive team – almost certainly Western-made equipment. Unfortunately, the projectiles didn't strike the opposing UAV – it continued its flight toward its target.

Intermittently, this persisted until dawn. Kyiv faced the early updates: multiple fatalities, devastation and infrastructure problems in many homes as a result of the evening attack. As customarily, everyone still maintained normal activities – living the war. But those entire period illustrated Ukraine's critical military reliance on Western support – a need that neighboring countries are demonstrably unable to replace in the short term.

Unsuccessful Negotiations

The detailed framework from American leadership sparked intense emotion, controversy and deep concern – and momentarily shifted focus from Ukraine's major integrity crisis in years. Yet, we have experienced comparable situations, after previous diplomatic encounters and bilateral conferences.

Every new initiative from US leadership adheres to the identical sequence: a negotiation push against Ukraine, which Kyiv, with other European capitals, manages to fend off. They manage the tension but never actually secure success. This cycle will, no doubt, continue.

Tactical Assessments

It is tempting to accuse certain parties of consistently pushing Moscow's conditions. But that does not seem to be the complete picture. US administration works based on a principle well known to international relations experts: you cannot win at the negotiating table what you have been unable to protect through force. The American government presumes that it is unrealistic to force Russia to surrender the territory that it presently holds in Ukraine's southern or eastern regions.

The challenge is that while accepting these circumstances, Washington does nothing to deter Moscow, through words or deeds, from assuming that the situation will not evolve additionally in its favour in the coming year.

Divergent Views

Therefore, Russian leadership is confident that duration works to their advantage – that Ukraine and its allies are nearing depletion. Their reason to accept conditions that does not give them the maximum possible gain is virtually nonexistent. There may be numerous efforts to achieve ceasefire, but they will continue as long as Russia's government remains highly assured in the conclusion.

On the contrary, Kyiv believes that Ukraine can still endure, progressively conceding people and territory but preventing a total frontline collapse until circumstances change in its advantage.

Existing Situation

Objectively, there are no real preconditions for a truce. Now, personal considerations are coming into play: leadership ambitions to broker a ceasefire and achieve global acclaim, and the government's double obstacles – on one hand, not to estrange crucial supporters, and on the other, to unite the population around the national cause against any initiative Kyiv finds unworkable, so that their focus does not switch to domestic problems. And although their task will now be considerably more difficult after recent developments, it remains highly unlikely that this will change their overall approach.

These two forces are guiding negotiations.

Assessment and Future

It took a mere seven days to eliminate the proposed articles of the latest plan. Aggressive and erratic handling of the matter by Washington, pushback by Ukraine and the rest of Europe, along with calming attempts of diplomats, and finally, latest revelations, all achieved their purpose.

While new plans based on old ideas are forthcoming, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to resist political attacks from Washington that are rooted in Kremlin requirements and show particular unwillingness to change the course of events, if they stand together and improve their protective measures at a considerably quicker tempo. If they do, neither political nor armed coercion will be able to break them. In the meantime, Ukraine's capacity to counter nocturnal attacks will, for the coming months, largely rely on sustained allied backing.
